By using Talaiot you accept these terms. If you do not agree, do not use the app. These terms form an agreement between you and Guillem Reig Martin, Spanish tax ID (NIF) 39404606V, address Calle Cristina 19, 08301 Mataró (Barcelona), Spain, email talaiot.tcg@gmail.com ("we").

The service

Talaiot lets you identify, catalog and value Pokémon TCG cards, and share collections and messages with other users.

License to use

We grant you a limited, non-exclusive, non-transferable and revocable license to use the app for personal, non-commercial purposes, subject to these terms.

Your account

You are responsible for keeping your account secure and for the activity carried out with it; provide accurate information and do not share or transfer your account to anyone else. You must be at least 14 (the minimum age stated in the Privacy Policy). If you are a minor, you need permission from your parent or legal guardian, who is responsible for supervising your use of the app.

Acceptable use

• Do not harass, threaten or insult other users.
• Do not send spam or illegal, offensive or infringing content.
• Do not copy, modify, decompile or reverse-engineer the app.
• Do not attempt to breach the security of, or interfere with, the app or other users.

User content

You are responsible for the content you post (public collections, profile, messages). We may moderate, hide or remove content and suspend accounts that break these terms. You can block and report other users.

Intellectual property and no affiliation

Talaiot is an independent app and is NOT produced, endorsed or sponsored by The Pokémon Company International, Nintendo, Game Freak or Creatures Inc., or any of their subsidiaries, nor affiliated with them. Pokémon, the Pokémon Trading Card Game (TCG) and all related material —card images, trademarks, logos, names and characters— are registered trademarks and property of their respective owners. References to Pokémon content are shown for informational and reference purposes, and we claim no rights over that intellectual property. Card and price data comes from third parties and is provided without warranty of accuracy.

Intellectual-property responsibilities

You agree to use Pokémon-related content only for personal, non-commercial purposes, not to redistribute, sell or commercially exploit it, and to respect the rights of its owners. If you are a rights holder and believe your rights are being infringed, contact us at talaiot.tcg@gmail.com.

Prices

Displayed prices are indicative, for information only, and do not constitute financial or investment advice.

Talaiot Pro (subscription)

Some features (graded-card market prices, your collection's evolution charts, wishlist price alerts and the two batch scanning modes: multi scan and the photo of a whole binder page) require the paid "Talaiot Pro" subscription: an auto-renewable subscription, monthly or yearly as you choose, whose price, taxes included, is shown in the app before you confirm the purchase.

• Free trial: the monthly plan includes a free trial period (currently 7 days) for those who have not used one before; the yearly plan has no trial. When the trial ends, the chosen plan is charged unless you cancel at least 24 hours before it ends. The trial length and the price afterwards are shown in the app before you confirm.
• Payment is charged to your App Store or Google Play account when you confirm the purchase. We never receive or store your payment details.
• The subscription renews automatically for periods of the same length as the chosen plan (one month or one year) unless you cancel it at least 24 hours before the end of the current period.
• You can manage or cancel it at any time from the subscription settings of your App Store or Google Play account. Cancellation takes effect at the end of the period already paid, which you keep enjoying until then; no pro-rata refunds are given for partial periods, without prejudice to the store's refund policies.
• If the subscription ends, you will no longer see graded prices or the other paid features; scanning cards one by one, ungraded market prices and the rest of the app and your data are unaffected, and the graded values saved to your collection while subscribed are kept.
• Deleting your Talaiot account does NOT cancel the subscription: remember to cancel it in your store's settings.
• We may change the price or content of the subscription. Price changes are communicated through the store and do not apply until the next renewal, which you can cancel if you disagree.

Right of withdrawal

If you are a consumer in the European Union, you have 14 days to withdraw from the purchase. By starting the subscription you expressly consent to the digital service beginning immediately. Withdrawal and refund requests are handled through the store where you purchased (Apple or Google), following their procedures; you can also write to us at talaiot.tcg@gmail.com.

Third-party services

The app may integrate with or link to third-party services (for example, Cardmarket links). We are not responsible for the content, availability or practices of those third parties; your use of them is at your own risk and governed by their own terms.

App store terms

If you download the app from the App Store or Google Play, your use is also subject to Apple's or Google's terms, which you agree to comply with.

Termination

You can delete your account at any time from Settings. Deleting the account does not by itself cancel a subscription purchased through the store (see "Talaiot Pro"). We may suspend or close accounts that break these terms.

Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or non-infringement. We do not guarantee it will be uninterrupted or error-free.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from use of the app, including loss of data or the inaccuracy of third-party data.

Indemnification

You agree to hold us harmless from any claims, damages or expenses (including legal fees) arising from your breach of these terms or misuse of the app.

Governing law

These terms are governed by Spanish law. Without prejudice to the rights granted to consumers by consumer-protection law, any dispute shall be submitted to the courts of Spain.

Severability

If any provision of these terms is found invalid or unenforceable, the rest remains in full force.

Entire agreement

These terms and the Privacy Policy constitute the entire agreement between you and us regarding the app.

Changes

We may update these terms and will notify you of relevant changes within the app.
